Who is Alan Moher?

Alan Moher, 57, and Caroline Moher, who have three children together, separated in 2016 after 21 years together and were divorced in family court.


However, Moher did not give her a ‘Get’, a document that formally recognizes the end of marriage in the Orthodox Jewish faith.

This meant that he could not remarry, have more children, or enter into a relationship with another man.


Moher filed a private complaint on one count of controlling or coercive behavior between January 2016 and January of last year in what his attorneys described as “a landmark case.”

Moher, from Salford, was due to stand trial at Southwark Crown Court last February, but his guilty plea was changed.

Charged

Prosecutor Anthony Metzer QC said Moher prevented his wife from remarrying by withholding the Get.

He told the court that Moher offered his wife £700,000 in the civil divorce with Get or £780,000 without him.

Metzer told the court that in August 2015 Moher was “so exhausted” from the “psychological and emotional abuse” she had suffered that she attempted suicide.

The court heard that in the process of the suicide attempt, Ms. Moher texted her husband to tell him what she had done.

‘He replied, ‘What color do you want your tombstone?’ Metzer said.

On January 22, 2016, the day Moher received a letter from Ms. Moher’s attorney informing him of her divorce proceedings, he told her wife to ‘fuck off’ and to ‘snuggle up and die’.

The next day, he grabbed her, put his hands around her neck, spat on her face and threatened to kill her.

Victim

A victim impact statement for Ms. Moher was read in court.

She would say, ‘Imagine being put in a straitjacket, gagged, having your hands and feet tied.

You are blindfolded. You are in a cold and dark place. Your only weapon is that you are able to hear. You depend on your captor to free you. That’s how I feel even being married to Alan.

Jeffrey Israel, defending, said: “My client is a 57-year-old man, and aside from a single public order incident, I would ask the court to treat him as a man of good character.”

The court heard that Mr. Moher was entitled to have 10 percent of his sentence waived because of his guilty plea on the first day of the trial.

Mr. Israel asked the court to take into account that the timing of his client’s guilty plea occurred after CPS belatedly indicated that he would not take up the case.

He told the court that his client had asked CPS if they would take up the private prosecution’s case on February 11, 2021.

Family


Moher, from Salford, was due to stand trial at Southwark Crown Court  last February but changed his guilty plea.

The couple separated in 2016 and the family court granted a decree nisi that same year, but the divorce process was not finalized until 2019.

They remain married under Orthodox Jewish law.

After the sentencing, Ms. Moher addressed the press outside the court.

She said: ‘My hope is that this case sends clear messages to abusers and their victims.

“For those who have emotionally coerced and controlled, physically hurt and dehumanized their spouses, the law will not let them get away with it.

‘For those victims, they are not alone, and justice and humanity are on their side.

‘I urge you not to remain silent, but to fight for your freedom.’
