Celeste Manno Biography
Who was Celeste Manno ?
The fate of a man accused of the gruesome stabbing murder of a young graduate will depend solely on a judge’s decision.
Luay Nader Sako, 36, of Roxburgh Park, last year pleaded not guilty to the brutal stabbing murder of Celeste Manno before obtaining an evaluation from a forensic psychiatrist to back up the claim that she was not capable of committing the crime due to his poor mental health. Health.
On Monday, the High Court of Victoria heard from two forensic psychiatrists who assessed that Sako was in disagreement about whether he was fit to stand trial.
Death
Celeste Manno was in the prime of her life when she was stabbed to death in her own bed.
The decision will now be decided by a judge in a contested investigative hearing that will last three days in October.
The court heard as Dr. Andrew Carroll, on behalf of Sako, argued that the alleged killer was too mentally ill to properly direct his attorneys, Dr. Clare McInerney, for the prosecution, believes the prognosis could be cured.
Before Covid-19 devastated Victoria’s justice system, such decisions would have been decided by a jury rather than a judge.
While juries are now actively deciding cases inside the Supreme Court, the court heard that mental fitness trials remained under the jurisdiction of one judge only.
‘Until the current provisions are repealed, that is the position. It is not an optional position, it is just a judge, ”said the judicial secretary.
At a hearing in March, the court heard that Sako had obtained a “second opinion” on his mental capacity after being unconvinced by his original assessment.
In a 30-page report, Dr. Carroll found that Sako was not only unfit to stand trial for the alleged murder, but would remain so for at least the next year.
The court heard from the psychiatrist, who examined the physical condition of Bourke Street killer James ‘Dimitrious’ Gargasoulas, and stated that Sako’s was a ‘complicated situation’.
On Monday, the court heard that Dr. McInerney believed Sako had a “more favorable prognosis” depending on his treatment.
Crown prosecutor Patrick Bourke said Sako’s mental fitness should be the subject of a thorough investigation in court.
“He will present that Mr. Sako is fit (to stand trial),” he said.
If the judge is satisfied that Sako is not fit to stand trial, the killer will be committed to a mental health facility until the forensic doctors consider him well enough to be released back into the community.
Many killers treated in this way are secretly returned to the community within a few years.
