A white New York City mother said she feared for her daughter’s life as a group of protesters started attacking her car and decided to hit the gas, eventually plowing into a group of activists last year.
Kathleen Casillo, 53, a retired FedEx worker of over 20 years, faces seven years in prison after turning down a six-day community service and one year license suspension plea deal on Wednesday, for the collision in which nine activists were injured.
Casillo, of Howard Beach, Queens, had been going Christmas shopping with her then 29-year-old daughter, Dominique, on December 11, 2020, when she says a group of protesters started banging on her car and breaking her daughter’s window at the intersection of 39th Street and Third Avenue.

‘My side of the story was we were attacked by people who were going to break my daughter’s window and pull her out of the car, so I feared [for] my life,’ Casillo, whose husband works as a car mechanic, told DailyMail.com in an exclusive interview on Thursday.
She said she turned down the plea deal because she did not do anything wrong, saying: ‘I’m going to court to clear my name because I’m not guilty.’
‘I feel sick,’ she continued, noting: ‘I never intended on hurting anyone. I just feared for my daughter’s life more than anybody. I thought they were going to pull her out of the car.
‘They’re just making the black community look like they’re thugs. One of my closest friends is a woman of color, from when I was 19-years-old, so it’s not a black, white thing. I don’t know even know the color of the people that I hit. It was all mixed.’

Video posted to social media in the aftermath showed the moment she plowed through a group of 50 Black Lives Matter protesters that night.
She was issued a desk appearance ticket for the incident and was released only hours after her arrest. Casillo, a mother of three, was later charged with reckless assault in the third degree on February 22.
Cops have been forced to guard Casillo’s home over death threats sent to her and her family, her daughter Dominique said.
‘We actually had to have the police on the block the first week it happened,’ Dominique recounted to DailyMail.com.
When Casillo appeared in Manhattan Criminal Court on Wednesday, she had to be escorted into the building by security officers, as a group of protesters outside compared her to a female Kyle Rittenhouse.
Describing being attacked last year, Dominique told DailyMail.com on Thursday: ‘You know when you picture a protest, you picture a bunch of [people] protesting for something. That’s not what we saw.’
She said what she experienced that day was a ‘traumatizing situation,’ saying she and her mom were driving down ‘an empty street’ when ‘a few people came out of nowhere.
‘It didn’t look like a protest,’ Dominique recounted. ‘It was more like being attacked by random people who were being menaces.’
She alleged that the people who were attacking the car ‘weren’t really part of the protest,’ as the actual protest ‘was a block up.
‘They were just lingering and pulled out of nowhere before we stopped the car,’ Dominique said. ‘We waited, watched the light turn green [then] red.

‘We waited a long time, and they were just there there like this, doing nothing.
‘Then they walked away just a little bit so we could move,’ she alleges. ‘We started driving and they started attacking the car. So naturally we stopped again, and that’s when they started hitting [the] car, cursing us out. I was really scared honestly.
‘Finally there was a bit that actually cracked the window open on my side and that’s when my mother started to roll,’ Dominique said. ‘We said we have to get out of here because they’re not going to stop.
‘There was no other car around,’ she continued. ‘There might have been cars behind us, but we were the first car on an empty sidewalk, so was it just like “wrong place, wrong time?” I don’t know.’
She noted that it was ‘sad because I definitely think there’s some bad menaces that go and ruin protest because there were people there protesting for a cause and they were just there looking for a trouble.’
Now Casillo fears going into Manhattan, Dominique told DailyMail.com, and ‘definitely has PTSD’ for which she is seeing a therapist.

Her attorney, Oliver Storch said he now hopes Casillo could receive a fair trial, despite protesters claiming she is racist and intentionally drove through the crowd.
Casillo is due back in court on January 28.
In the interview with DailyMail.com, Storch claimed Casillo is not the racist zealot some protesters are making her out to be. He said she simply decided to go into Manhattan to go Christmas shopping with her daughter on December 11, 2020 when she ‘happens to get swarmed by a mob of angry protesters’ at the intersection of 39th Street and Third Avenue.
The car was impounded after the collision, Storch said, but because it was leased Casillo has continued to have to make payments on it for the past year.
‘This is an unfortunate incident,’ he told DailyMail.com, adding: ‘Not every accident is a crime.’
In the aftermath, Dominique said, her mother was slammed as a racist on Twitter, calling it ‘really traumatizing.’
People took to social media to post screenshots of her Facebook and Instagram accounts, The City reported at the time, showing posts supportive of then-President Donald Trump’s handling of the COVID pandemic and likes for a group called ‘I stand with Rudy Giuliani.’
The accounts had been deleted in the aftermath, but appear to have been reinstated, albeit without much information made public.
Her Facebook profile now just shows likes for pages about making September 11 a ‘MAJOR National Holiday,’ and putting the Twin Towers on New York license plates. She also follows a page entitled ‘Conservative Politics Today,’ and still seems to be a member of the ‘I stand with Rudy Giuliani’ Facebook group.
But Casillo has denied claims of racism, telling DailyMail.com: ‘One of my closest friends is a woman of color, from when I was 19-years-old, so it’s not a black, white thing.

‘I don’t even know the color the people that I hit,’ she continued. ‘It was all mixed.’
Storch, her attorney, has also rejected claims that Casillo is racist and intentionally hit the protesters, calling it a ‘false narrative’ that is ‘without merit and deeply disturbing.’ He notes that Casillo did not have a prior criminal history and has ‘no history of having hurt anybody,’ claiming ‘her heart goes out to the victims.’
He said he now hopes Casillo could get a fair trial, claiming protesters who gathered outside the Manhattan Criminal Court on Wednesday were trying to intimidate the prosecutors’ office and Manhattan District Attorney for harsher punishment and sentencing.
‘Mob rule should never be a substitute for letting the legal justice system run its course,’ he said, noting: ‘We want this case to be treated like every other case,’ and ‘We simply ask that Ms. Casillo be given her day in court.’

But outside the court room, BLM protesters waited for what they deem to be justice for Casillo’s actions.
She had been captured on video plowing through the demonstration last year which had left at least nine protestors wounded.
‘Last year on Dec. 11, Kathleen Casillo drove her car at top speed through a crowd of human beings. I was one of those human beings—I never saw her coming,’ Roque Rodriguez told AMNY.
‘She hit me flush from behind and set my body flying and flipping through the air and she kept driving.
‘It’s white supremacy that allowed Kathleen to believe she had the right to end the lives of anyone that got in her way, especially BLM protesters.’
‘It has been a very long year. Kathleen Castillo’s car left me with five bulging discs in my back and a traumatic brain injury,’ Tabitha Howell said.
‘It’s one thing to face physical recovery. It’s another to try to process what happened mentally and emotionally.’
The protestors had also chastised Assistant District Attorney Andrew Mercer as they believed he had given Casillo a ‘lenient’ charge.
‘Andrew Mercer neglected to follow up with seven of the nine people who were directly hit and impacted by this crime,’ Rodriguez added.
‘You’ve never spoken to them. He did no due diligence, and instead assumed that Kathleen did not have bad intentions and that no one else was seriously harmed.’
In a statement to AMNY, the Manhattan District Attorney’s office said: ‘Our office has attempted to speak with every victim in this case.’

Casillo, though, insists she was the victim, and says she only drove off after the protesters began attacking her car as she tried to move along a public road. She claimed at the time she panicked and hit the gas as protesters began banging on her car and trying to open the doors, the New York Daily News reported last year.
The group of protesters were holding a demonstration in Manhattan’s Murray Hill neighborhood to show support of those on hunger strike at an ICE facility in Bergen County, New Jersey.
Multiple people being held in the government facility have gone without food for four weeks now to draw attention to their poor treatment in the facility.
Video footage had captured the moment during the protest when Casillo then plowed her vehicle through the crowd.
The footage revealed a few protestors surrounding Casillo’s vehicle before the incident as a couple of them appeared to be banging on her car.
She had also claimed she did not remember hitting anybody when her foot was on the accelerator as she attempted to flee the scene.

In the aftermath, a protester, Nicolle Besuden, was also arrested for interfering with an EMT rendering medical aid to one of the injured victims.
She was charged with disorderly conduct and obstruction of governmental administration, and was also given a desk appearance ticket.
She said in an email to the Gothamist afterward that she was helping an injured friend tell first responders to give him some space, as he was becoming distressed at the number of police responding to the site.
She claimed: ‘I would never stop medical professionals from assisting an injured person.’
