A ‘tiny’ teenager escaped conviction for lashing out at police officers during a wild Australia Day party because she couldn’t handle her alcohol.

Madison Tammy Alexia O’doherty, 19, appeared in Caloundra Magistrates Court on the Sunshine Coast on Wednesday charged with five offences relating to an out-of-control brawl on January 26, 2020. 

Her lawyer told the court she had been drinking on an empty stomach since 9am celebrating Australia Day, and had polished off half a case of vodka cruisers before police arrived. 

They were responding to complaints made by the public, but O’doherty lashed out at them and riled up some of her friends, who also became aggressive toward officers, Sunshine Coast Daily reported.

‘My client hadn’t eaten all day and as you can see she is a tiny thing,’ defence lawyer Rachel Holland said. 

Police prosecutor Amanda Brewer explained there were children and families present at the Eleanor Shipley Park at the time of the incident, and they witnessed O’doherty’s outburst.

The teenage receptionist called officers c**ts, told them to f**k off and threw rubbish at them while they arrested some of her friends.

‘That’s made the police officers’ jobs extremely difficult because her actions were inciting the group of people to join in the abuse and were acting physically towards police,’ Senior Constable Brewer said.

At one point, she used her body weight to try to pry a police officer off one of her friends, who was under arrest.

When O’doherty was also placed under arrest, she flew into a rage and continued to lash out at officers.

‘Her behaviour, which was viewed by police as disgusting, continued en route to the Maroochydore Watch House including calling police various names and banging on the side of the van,’ Senior Constable Brewer told the court.

One charge of assaulting a police officer was withdrawn on Wednesday after police presented no evidence of the incident.

O’doherty then pleaded guilty to three counts of obstructing police and one count of public nuisance. 

She had no criminal history and her lawyer told the court she was embarrassed and remorseful.

Ms Holland described the behaviour as ‘very out of character’.

O’doherty was issued a 12 month good behaviour bond, and no conviction was recorded.
