Her partner, Darryleen Koolmatrie, 23, died in the accident just three weeks after she gave birth to her baby, named Grantley after her father.
She was rushed to hospital before being pronounced dead, while Penny only received minor injuries.

Penny was driving 112 km/h in a 70 km/h zone at 11:20 the morning of the accident and lost control of the car.
She slid sideways for about 50 meters before crashing into a concrete median strip and flying into the air.
The passenger side then crashed into the wooden post, snapping it in half.
He had been raining before the accident and it was later revealed that the car’s front left and right rear tires were below the minimum safe tread depth.
Penny told the court that he did not know about the condition of the tires until the accident.
His license had also expired for four years at the time of the accident and tests revealed that he had been driving with a combination of prescription drugs and cannabis in his system.
‘I remember I came around the corner and it just slid, it just slid, you know? The tires were worn out and I couldn’t bring them back,’ Penny told police after the accident, according to WA Today.
Her attorney, Patti Chong, called the accident “a tragedy of Shakespearean proportions.”
“The offender not only killed any innocent bystanders or victims, he killed the love of his life, the mother of his three-month-old son,” she said.

While she was out of court, she called the sentence “disgusting.”
‘She only got two years (before parole). I have all my life, her son has all my life,’ she said.
Blurton said that he had been reunited with his daughter after 20 years and that he was “really happy.”
“Then all of a sudden, three years later, they took her away,” he said.
