Kenneth Gasper is charged with telephoning in the threat directed at Garbarino, which represents parts of Long Island, on Wednesday, according to Nassau police.
Authorities said Gasper allegedly acted badly because he disagreed with a “recent congressional vote” by the legislator.
Gasper was charged with aggravated harassment, police said.
Garbarino voted in favor of the infrastructure bill on November 5, along with a dozen of his Republican colleagues in the House.

Since then, lawmakers have come under heavy criticism from members of their own party.
Representative Andrew Garbarino, who represents New York’s 2nd Congressional District, supported the $ 1.2 trillion bipartisan infrastructure bill.
On Wednesday, Garbarino spoke to The Post about the recent harassing comments directed against him.
“I had the police at my house, and they are more concerned about these [threats] that have been coming in than they are about the ones I have received in the past,” Garbarino said.

“There are members of Congress who are raising funds from their misinformation and attacking us, and that is causing us to receive death threats from the other side.”
