Who was Phylesia Shirley?
Prosecutors say Kyrell was repeatedly beaten by his mother Phylesia Shirley, 24, and then-partner Kemar Brown, 28, over several weeks, using secret audio recordings capturing the alleged violence.
In one of the recordings, Brown is heard saying “you have to spoil the fun” during an assault on Shirley’s one-bedroom apartment in south London, prosecutors said.
The couple deny the murder.
Shirley is said to have conducted the undercover phone recordings in her one-bedroom apartment to verify if Brown was secretly contacting other women.
Prosecutor Edward Brown QC told the jury at the Old Bailey: “Kyrell had his ribs crushed or broken from beatings.

“At least one of the defendants clearly inflicted a significant number of injuries in at least five separate incidents in the four weeks prior to…Kyrell’s death.
“The pain and anguish in those four weeks in which he was abused were vividly highlighted in those harrowing recordings.
“On October 20, his ribs were crushed once again, that killed him.”
Police later found the secret audio files on Shirley’s mobile phone, which were apparently attempts by the mother trying to catch Brown being unfaithful but inadvertently capturing the abuse, the prosecution said.
They included several audio files where it appeared that Kyrell was hit repeatedly, with Brown saying “shut up,” causing the boy to cry and scream.
Prosecutors say another time Brown punched the little boy several times before telling him, “You have to spoil the fun.

Another file captured Shirley beating her own son and causing him to cry in anguish, the prosecution told the court.
The prosecutor said that Shirley wanted to stay in a relationship with her partner, despite knowing that she was abusing her son.He said: “In fact, you may well conclude that she joined in the abuse.
“I was prepared to reject what should have been motherly care in protecting Kyrell in favor of abuse by her, her own mother, and in favor of abuse by a man who knew he was abusing Kyrell’s son.” her.
“The truth is that his death occurred when he was mistreated once again on that floor, once again in a very similar way, causing very similar injuries, only this time it was much more serious, the mistreatment and the results were catastrophic. . ”
Jurors heard that the toddler did not attend daycare and was therefore in the full-time care of his then-21-year-old mother, and that neither defendant was employed in the period leading up to Kyrell’s death.
Both defendants claim they left the apartment at separate times, briefly, on the day Kyrell died, although CCTV could only corroborate Shirley’s account.
Charged
Both Shirley and Brown, with separate addresses in Thornton Heath, south London, deny the murder.
Brown also denies two other charges: causing or allowing death and causing or allowing serious bodily harm to a child.
Mark McDonald, for Brown, told the jury that his client’s case will be that the injuries inflicted were the result of incorrect advice from NHS 111 on how to resuscitate the child.
Shirley has admitted to allowing death and allowing serious bodily harm to a child.
